52 constituteproject.org Colombia 2021 In addition to what is stipulated in the preceding articles, the law shall establish other recourses, actions, and procedures to defend the integrity of the legal order and individual, group, or collective rights against actions or omissions by public authorities. The State shall be liable for unlawful damages caused by public authorities’ acts or omissions. In that event that the State is ordered to pay compensation for damages caused by wrongful or gravely negligent acts of one of its agents, the State in turn shall demand restitution from the agent. In the event that a state agent, following orders from his/her superior, gravely breaches the Constitution so he/she causes harm to another person, this fact does not exempt him/her from responsibility. Members of the military in active duty are exempt from this provision. Where members of the military are concerned, responsibility shall fall exclusively on the superior officer who gave the order. Any person or legal entity may solicit from the competent authority the application of penal or disciplinary sanctions stemming from the behavior of public authorities. International treaties and agreements ratified by Congress that recognize human rights and prohibit their limitation in states of emergency prevail in the internal legal order. The rights and duties mentioned in this charter shall be interpreted in accordance with ARTICLE 90 ARTICLE 91 ARTICLE 92 ARTICLE 93 ARTICLE 89
