Abstract This document is intended to show what the role of the Constitutional Court has been on the lack of protection of civil rights which citizens are exposed to due to judi- cial delay and, above all, the limits on the normative that jurisprudence has imposed onto this practice. I am intended to demonstrate that constitutional jurisprudence has not served as a platform for justifying judicial delay. On the contrary, it has contribu- ted to limiting this practice and protecting civil rights. I try to avoid referring to the institutional aspects that generate judicial congestion among other issues since it is a matter that falls to the legislator and the Judicial administrative authority branch to define. However, I emphasize the ethical commitment of judges, (as a drive to diligent justice) is not enough to decongest the judicial apparatus of the Colombian State as long as the other state powers do not contribute jointly to this purpose.
